 Article 1 – Definitions

Website: refers to the website under the domain name https://www.fontodevivo.fr/.

Customer: refers to any natural person acting as a consumer or non-professional visiting or purchasing on the Website.

FONTO DE VIVO: refers to the simplified joint-stock company FONTO DE VIVO, with a capital of €10,000, located at 42 Rte d'Abbaretz, 44170 Nozay, registered with the Nantes RCS under SIRET number 989 096 227 00016, VAT number: FR08989096227; eco-contribution identification number: FR241248_01JKB.

Account: called "My Account" on the Website, refers to the login account that allows the Customer to access their personal area and place product orders.

Order: refers to a product request made by the Customer.

Product(s): refers to the products offered for sale on the Website.

Personal Data: any information relating to an identified or identifiable natural person, directly or indirectly.

Terms of Use: refer to the general terms and conditions of use applicable to any Customer accessing the Website, also called "TOU".

Terms of Sale: refer to the Terms of Sale applicable to all sales concluded between FONTO DE VIVO and Customers, also called "TOS".

Article 2 – Scope

These Terms of Use aim to define the terms and general conditions for using the Website and its features.

By browsing the Website, the Customer confirms having read and understood these TOU and agrees to comply with them.

These TOU may be revised at any time.

These TOU are complemented by the Terms of Sale.

Article 3 – Website Accessibility

3.1 Access Conditions

The Website is accessible to all Internet users, provided they have an Internet connection.

Use of the Website is free of charge, with no purchase obligation.

Access to the Website does not require the creation of a Customer Account; however, creating an Account is necessary to place an Order (for details, see Article 3 of the Terms of Sale).

3.2 Customer Account

To place an order on the Website, the Customer must first create a personal account according to the procedures described below.

To create an Account, the Customer must fill out a form providing all necessary personal information for account creation and order execution, including title, last and first name, billing address, delivery address, a valid email address (used as login), and a password. The Customer also indicates the intended use of the products. The Customer declares being of legal age and agrees to provide truthful and accurate information. The email address must be valid and accessible. FONTO DE VIVO is not responsible if the Customer cannot access their email temporarily or permanently.

The Customer agrees to regularly update their information, especially before each order.

Each time the Customer wishes to access personal information in "My Account" or place a new order, they will log in using their username and password.

Providing login credentials online constitutes proof of identity and has the value of an electronic signature under the Civil Code. Credentials are personal, confidential, and non-transferable. The Customer is fully responsible for their use and must ensure no unauthorized person accesses their account.

The Customer agrees to immediately inform FONTO DE VIVO of any unauthorized use of credentials or any security breach.

FONTO DE VIVO cannot be held responsible for errors or omissions in Customer information affecting order delivery. FONTO DE VIVO may verify the accuracy of personal information and request corrections, reserving the right to suspend or terminate contractual relations or access if information is incorrect or misleading.

To delete their personal account, the Customer must access their Account and click "Delete my account".

Article 4 – Liability

4.1 FONTO DE VIVO’s Liability

FONTO DE VIVO is only bound by a best-efforts obligation in providing the services on the Website.

FONTO DE VIVO will make reasonable efforts to secure access and use of the Website and may choose the technical means to offer Website functionalities.

The Website is available 24/7.

However, the Website may be temporarily unavailable for maintenance or events beyond FONTO DE VIVO’s control.

In case of technical failure affecting the Website, FONTO DE VIVO will make efforts to restore it promptly.

FONTO DE VIVO is not responsible for external intrusions, computer viruses on the Customer's system, misuse of the Website, network failures, or delays.

In general, FONTO DE VIVO cannot be held responsible for any risk-taking behavior by the Customer using the Website.

All order-related claims are governed by the Terms of Sale.

4.2 Customer’s Responsibility

The Customer is solely responsible for using the Website.

The Customer agrees not to act contrary to these TOU and, more generally, applicable laws and regulations.

Article 5 – Force Majeure

FONTO DE VIVO is not liable for non-performance or delayed performance due to force majeure under Article 1218 of the Civil Code.

Force majeure events include, but are not limited to:

  • Network or communication system blockages;
  • Total or partial strikes, lockouts, boycotts, or similar events;
  • Cyberattacks.

Article 6 – Personal Data

The Customer is informed that all data collected for Website operation is processed by FONTO DE VIVO.

Article 7 – Cookies

Article 8 – Inquiries

For information, questions, or complaints, the Customer may contact FONTO DE VIVO’s customer service via the available contact points (phone, email, forms). Responses are provided Monday to Friday (excluding holidays) from 9:00–12:00 and 14:00–17:00 CET.

Article 9 – Intellectual Property

The Customer agrees to respect FONTO DE VIVO’s intellectual property rights, including Website content, trademarks, designs, images, texts, site structure, graphics, databases, logos, domain names, and any other distinctive signs, protected under French and international laws.

No intellectual property rights are transferred to the Customer.

Reproduction of FONTO DE VIVO’s intellectual property is strictly prohibited and may constitute infringement.

The Customer may reference the Website for advertising or promotional purposes only with prior express consent.

Any violation of intellectual property rights engages the Customer’s responsibility.

Article 10 – Modification of Terms of Use

FONTO DE VIVO reserves the right to freely modify these TOU at any time to comply with legal or regulatory developments.

All modifications are directly applicable to the Customer.

Article 11 – Severability

If any clause of these TOU is declared void, it is considered unwritten without invalidating the remaining clauses.

Article 12 – Applicable Law

These TOU are governed by French law.

Article 13 – Jurisdiction and Dispute Resolution

Disputes between FONTO DE VIVO and the Customer will first attempt amicable resolution.

If no agreement is reached, disputes will be brought before competent courts under general law, including multiple defendants, expressly accepted by the Customer.

In case of dispute, the Customer should first contact FONTO DE VIVO’s customer service. If unresolved within 20 days, the Customer may refer the matter to the European Mediation Association (AME CONSO) within one year of written complaint submission.
